The County Borough of Conwy (Disabled Person's Parking Places) (No. 1) Order 2024 - Part 1


The Conwy County Borough Council (hereinafter referred to as "the Council") in exercise of its powers under Sections 1, 2 and 4 and Part IV of Schedule 9 of the Road Traffic Regulation Act 1984 (hereinafter referred to as "the Act of 1984"), and of all other enabling powers and after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 to the Act of 1984 hereby makes the following Order:-

  • 1.  This Order shall come into operation on 16th of September, Two thousand and twenty four and may be cited as "The County Borough of Conwy (Disabled Person’s Parking Places) (No.1) Order 2024 - Part 1".

  • 2.  
    • (1)  In this Order:-

      "authorised parking place" means any parking place on a road authorised or designated by an Order made or having effect as if made under the Act of 1984;

      "disabled person's badge" has the same meaning as in the Disabled Persons (Badges for Motor Vehicles) (Wales) Regulations 2000;

      "parking disc" has the same meaning as  in Regulation 8 of  the Local Authorities’ Traffic Orders (Exemptions for Disabled Persons) (Wales) Regulations 2000;

    • (2)   For the purpose of this Order a vehicle shall be regarded as displaying a disabled person's badge in the relevant position, if -

      • (a)  the badge has not ceased to be in force; and
      • (b)
        • (i)  the badge is exhibited on the dashboard or fascia of the vehicle so that Part 1 of the badge is legible from the kerbside, or

        • (ii)  where the vehicle is not fitted with a dashboard or fascia, the badge is   exhibited in a conspicuous position of the vehicle, so that Part 1 of the badge is legible from the kerbside.

    • (3)  For the purposes of this Order a vehicle shall be regarded as displaying a parking disc in the relevant position if:-

      • (a)  the side showing the quarter hour during which the period of waiting began is legible from the kerbside.the disc is exhibited.

    • (4)  Except where otherwise stated any reference in this Order to a numbered Article or  Schedule is a reference to the Article or Schedule bearing that number in this Order.

  • 3.  Save as provided in Article 4 of this Order no person shall, except upon the direction or with the permission of a Police Constable or Civil Enforcement Officer in uniform, cause or permit any vehicle to wait at any time in the lengths of road specified in  Schedule 1  to this Order unless that vehicle is  displaying a valid disabled person’s badge and a residents permit.

  • 4.  Save as provided in Article 3 of this Order no person shall, except upon the direction or with the permission of a Police Constable or Civil Enforcement Officer in uniform, cause or permit any vehicle to wait  in the lengths of road referrfor so long as may be necessary to enable:-

    • (a)  The vehicle, if it cannot conveniently be used for such purposes in any other road, to be used in connection with any of the following operations, namely:-

      • (i)  Building, industrial or demolition operations.
      • (ii)  The removal of any obstruction to traffic.
      • (iii)  The maintenance, improvement or reconstruction of the said lengths of road.
      • (iv)  The laying, erection, alteration or repair, in or in land adjacent to the said lengths of road, of any sewer or of any main pipe or apparatus for the supplying of gas, water, or electricity, or of any Telecommunications apparatus as defined in the Telecommunications Act, 1984.

    • (b)  The vehicle, if it cannot conveniently be used for such purposes in any other road to be used in the service of a local authority or a public utility company in pursuance of statutory powers or duties.
    • (c) The vehicle of a universal service provider under Section 125 of the Postal Services Act 2000.

  • 5.  The prohibition and restrictions imposed by this Order shall be in addition to and not in  derogation from any restriction or requirement imposed by any regulations made or having effect  as if made under the Act of 1984 or by or under any other enactment.
