Prosecution for failure to comply with a Community Protection Notice

At Llandudno Magistrates Court on 20 January 2025, Miss Rachel Ellen Cheshire of Hillcrest Road, Deganwy was found guilty of failure to comply with a Community Protection Notice under the Anti-social Behaviour Crime & Policing Act 2014.

The Notice, issued to Miss Cheshire last year, related specifically to two vehicles left outside her property for five years, allowed to deteriorate and cause detriment to other residents, and also partially obstruct another resident’s driveway.

Miss Cheshire failed to attend at Court and the matter was heard in her absence.

The Magistrates deemed the case to be proven beyond reasonable doubt and imposed the maximum fine of £2,500, £424 costs, and a victim surcharge of £1,000. A total of £3,924.

Application for a Forfeiture Order under section 50 was also made and awarded. This allows for the vehicles to be seized and destroy after 21 days.

The Notice remains in force at this time and prevents Miss Cheshire from placing more vehicles at the location, which are not road legal, and also prevents her from placing vehicles so as to cause obstruction or nuisance to other residents.
